Emilie Kiser’s husband, Brady Kiser, noticed something unusual in the backyard of their family home before finding 3-year-old son Trigg in the pool.

In a redacted police report obtained by Us Weekly on Friday, August 8, Brady told authorities he was inside feeding Trigg and now 4-month-old son Teddy while watching an NBA playoff game between the New York Knicks and Boston Celtics. (The report indicated that Brady placed a bet on the game prior to Trigg’s death, noting that his attention was “divided” on the May 12 night.)

Trigg, meanwhile, went into the backyard and tripped into the pool after playing with an inflatable chair while Brady was allegedly inside.

When Brady was asked to recall the events during a second line of questioning, he claimed to have looked outside and saw the dog watching the pool and having a “poor feeling as soon as [he] saw it, it was out of the ordinary to see him standing there looking in the water as he was.”

Brady claimed that he “stood up” and “immediately” went outside, where he found his eldest son in the pool.

The police report also indicated that Trigg was outside unsupervised for more than nine minutes and was in the water for about seven of those minutes, despite Brady initially claiming the incident occurred in the span of only a few minutes. Authorities claimed that Brady’s statements “do not match” what the surveillance video showed, alleging that he was “not aware” of what Trigg was doing and “not watching him.”

Days after Trigg was pulled unconscious from the backyard pool, the Chandler, Arizona, Police Department confirmed to Us that he died on May 18. Investigators later reccomended that Brady be charged with a Class 4 felony charge of child abuse, however, the local Attorney’s Office ultimately opted against pursuing the charge.

“Surveillance video from outside the home showed how the drowning occurred and the actual timeline of events,” a statement read. “In order to convict a person of this charge, the state has to prove beyond a reasonable doubt to a unanimous jury that the person failed to perceive a substantial and unjustifiable risk, and that failure to perceive the risk was a gross deviation from the standard of care a reasonable person would show.”

Brady’s attorney Flynn Carey noted that they are “grateful to law enforcement and the county attorney for conducting a thorough investigation and confirming that this was a tragic accident.”

“Brady remains in the midst of the grieving process and is thankful to be with his family as they heal together,” the statement concluded. “We appreciate the compassion and support shown during this difficult time.”
