The employer of Perry Tole, the man allegedly attacked by former NFL quarterback Mark Sanchez, has broken their silence about the shocking altercation.

Tole, 69, works for Restaurant Technologies, a company that specializes in cooking oil delivery and hands-free waste cooking oil disposal.

While attempting to perform his duties in downtown Indianapolis in the early morning hours of Saturday, October 4, Tole was allegedly attacked by Sanchez, 38, who claimed Tole’s box truck was not allowed to be parked in an alley where the former New York Jets star was reportedly seen doing wind sprints. 

In a statement to the Indy Star on Wednesday, October 8, Restaurant Technologies explained they offer a variety of schedule options for their employees. 

“This aligns with the diverse schedules of the food service industry and allows our employees to find the shift that works best for their individual needs,” said Dave Cheng, spokesperson for Restaurant Technologies. “Deliveries may take place late at night or early in the morning so that we provide service at the most efficient and convenient time for our customers and maintain our high level of driver satisfaction through flexible scheduling.”

The company said it had reached out to Tole’s family to “offer support and [the company] will be determining what is needed in the days and weeks to come.”

Tole has been released from Indianapolis’ Methodist Hospital and is currently recovering at home.

In photos shared by his family on Sunday, October 5, Tole could be seen badly injured with a huge gash on his left cheek. Tole allegedly stabbed Sanchez multiple times in self-defense during the altercation, which also sent Sanchez to the hospital. 

Restaurant Technologies also expressed their “heartfelt thanks” to first responders on the scene for “providing exceptional assistance in responding to the incident, helping our employee reach safety and get medical care.”

Sanchez was initially charged with three misdemeanors for his role in the alleged attack: battery resulting in injury, public intoxication and unlawful entry of a motor vehicle.

The former quarterback, who was in Indianapolis to call the game between the Indianapolis Colts and Las Vegas Raiders on Sunday, allegedly attempted to enter Tole’s truck without permission. 

Marion County Prosecutor Ryan Mears announced Sanchez is now facing a level 5 felony charge during a press conference on Monday, October 6. The charge carries a penalty of one to five years in prison. 

Tole filed a lawsuit against Sanchez and Fox Corporation on Monday, saying he sustained “serious bodily injury” due to Sanchez’s “malicious, willful, wanton or grossly negligent conduct.”

According to the lawsuit, Tole suffered severe “permanent disfigurement, loss of function, other physical injuries, emotional distress and other damages.”

The lawsuit claims Fox has an obligation to ensure that its employees conduct themselves “in a reasonable manner.”

Tole argued Fox should have been aware of Sanchez’s alleged “unfitness” and his “propensity for drinking and/or harmful conduct.”

He is seeking compensatory damages, punitive damages, costs and expenses of this action, including attorney’s fees, and any other relief that the court deems just and proper.
