Sean “Diddy” Combs’ lead attorney, Marc Agnifilo, said he may seek home confinement for the music mogul instead of prison when Diddy is sentenced in October.

Diddy, 55, was convicted on two counts of transportation to engage in prostitution in early July, for which he could face up to 20 years in prison, less time already served. He has been detained at the Metropolitan Detention Center in Brooklyn, New York, since his arrest in September 2024.

Agnifilo told TMZ in an interview published on Friday, August 8, that the rapper’s legal team is weighing up the possibility of asking a court to remand Diddy to custody at home. Agnifilo said that Diddy would have better access to therapists and other support for anger management and substance abuse issues on the outside than he would in prison.

“He has therapists that we have basically lined up for him from the outside,” the lawyer said. “The MDC is very strong in certain areas … one of the areas it’s not so strong in, it does not have meaningful programming, so that is not really available to him on the inside.”

“If you were at a traditional post-conviction facility, there’d be more programming for him. So we have put things together,” Agnifilo explained. “He’s working very hard in therapy. I know he’s working hard on all these issues.”

Asked outright if he would seek a home confinement sentence, the lawyer said, “That is certainly an argument that I may make.”

“I’m certainly going to be asking the judge, as a condition of his supervised release, that he have the appropriate counseling and therapy. I think he needs it. I think he thinks he needs it, and that’s the important part,” he added.

At trial, Diddy was cleared of three further charges against him: two counts of sex trafficking and one count of racketeering conspiracy. The Bad Boy Records founder has maintained his innocence since his initial arrest and denied all the charges against him.

Earlier this week, another member of Diddy’s legal team, Nicole Westmoreland, revealed that the music star’s associates have reached out to President Donald Trump’s administration about a possible pardon.

“It’s my understanding that we’ve reached out and had conversations in reference to a pardon,” Westmoreland told CNN.

The attorney added that Diddy is “a very hopeful person and I believe that he remains hopeful” in relation to a pardon.
